The Executive Committee of the Kentucky Historical Society
THOSE WHO VOTED TO SUE THEIR OWN MEMBERS

The original Open Records Act request made by the Concerned Members of the KHS asked for the names & contact information of presiding officers for the purpose of contacting officers regarding issues of concern to the membership. The KHS denied this request, maintaining the names and contact information of the Executive Committee are private information. The KHS has yet to provide such information to its members.

This list was obtained when it was published and disseminated by the KHS itself, in the Kentucky Historical Society Chronicle, Annual Report. One must ask: Why is this information deemed private for members, yet deemed public when the KHS wants it to be public?

ONE WHO PREFERRED NOT TO SUE KHS MEMBERS
George Ward, Secretary of the Kentucky Commerce Cabinet,
the State agency that supervises the KHS.

According to sources inside the Commerce Cabinet, when authorization from him was requested to proceed with suit against the Concerned Members, he initially declined.


ONE WHO DROVE THE SUIT AGAINST KHS MEMBERS
Kent Whitworth, Executive Director of the KHS

When the Executive Director of the KHS, Kent Whitworth, a second time requested Ward's authorization to proceed with legal suit against the Concerned Members, Whitworth stated to Ward that the desire to sue was that of the Executive Committee of the KHS. The Executive Committee already had voted to proceed with legal action not only against the Concerned Members collectively, but also personally against Eric James, the group's Chairman, individually. Ward subsequently acquiesced.

Employees of the Commerce Cabinet, who also are members of the KHS, informed the Concerned Members that Kent Whitworth on at least two occasions had disparaged the Concerned Members publicly in Commerce Cabinet offices. The Concerned Members confronted Whitworth in a meeting with legal counsel Sarah O. Hall and KHS president Libby Jones present, and demanded the disparagement by Whitworth cease and desist.
