Lawful Conformity
Of the KHS

ISSUE

Conflicts in KHS by-laws & non-conformity with the Open Meeting Act and Open Records Act

POSITION

Oppose & seek lawful compliance

Inconsistencies have been identified by Concerned Members in the manner in which the Kentucky Historical Society conducts its business. The by-laws and charter appear to conflict. No evidence is shown of compliance with the State’s Open Meeting Act & Open Records Act.

* Regular meetings of the Board of Directors are not held on dates specified.

* The annual meeting is not held in the Old State Capitol as mandated.

* Headquarters of the Kentucky Historical Society are not in the Old State Capitol as mandated.

* Nominating Committee for election of officers is not being made by the Executive Committee.

* Directors occasionally succeed themselves when prohibited from doing so.

* Members are prohibited from participating in meetings of the board of directors in violation of The  Open Meeting Act

* Members have been denied access to records in violation of the Open Records Act.

Concerned Members seek lawful compliance by the Kentucky Historical Society with the Open Meeting Act & with the Open Records Act, and also seek conformity of its by-laws with the charter and state law.
